The federal suit cites the Federal Wiretap Act, part of an overall crime law passed in 1968. That law was updated in 1986 with the Electronic Communications Privacy Act, but has most been unaltered since then. The lawsuit alleges that not only did Spaw illicitly listen to the call, but she also recorded it on another device and then made transcripts of the call and shared them with McGraw. Freking declined to confirm that Spaw made a recording, but multiple sources have told The Enquirer that such a recording exists, as do transcripts.
